What "regional center" and "direct" actually mean

This is why most EB-5 capital in recent years has flowed through regional centers — the job-count math is easier to satisfy. But easier job math is not the same as lower financial or immigration risk.

Where regional center risk actually hides
With a regional center, you are trusting three layers at once: the regional center sponsor, the project developer, and the job-creation methodology used in the economic report. If any one of those layers is weak, your I-526E or I-829 can stall even if the project itself is financially sound. Common failure points include over-optimistic job-creation projections, commingled fund accounts, and loan documents that subordinate investor capital below other lenders without clearly disclosing it.

Franchises and small businesses marketed as "EB-5 ready" sometimes understate how thin that margin is — a slow hiring quarter or a role filled by a non-qualifying worker can jeopardize the whole petition, and there is no larger sponsor absorbing the shortfall for you.
One applicant believed the fund's marketing materials, which described the project loan as fully secured against the property, and treated repayment as close to guaranteed. The actual loan documents placed the investor capital behind a senior construction loan, something the applicant only understood after the source-of-funds and structure were reviewed line by line.
The comparison marketers won't make plainly
Fund marketers naturally favor regional centers because that is their product. Law firm blogs often stay neutral in tone but rarely walk through what actually breaks a petition at the document level. Here is the plain version: regional center risk is mostly about trusting someone else's structure and numbers; direct investment risk is mostly about your own operational proof. Neither is automatically the safer path — it depends on whether the specific project's paperwork, source-of-funds trail, and job-creation evidence can survive a line-by-line USCIS review.
